1. Who these terms are between
These terms form an agreement between you and IPTVhub Canada, a company registered in Canada with a principal place of business at 199 Bay Street, Suite 4000, Toronto, ON M5L 1A9. In this document, "we", "us" and "IPTVhub" mean that company, and "you" means the person or entity subscribing to the service.
By purchasing a subscription, requesting a free trial, or otherwise using the service, you accept these terms. If you do not accept them, do not use the service.
You must be at least eighteen years of age, or the age of majority in your province or territory, to enter into this agreement.
2. What the service is
IPTVhub supplies streaming technology and access to content distributed by third parties over the internet. We provide account credentials, server infrastructure, an electronic programme guide and customer support.
We do not host, produce, own or claim any rights in the media transmitted through the service. We are a technology and access provider, not a broadcaster or a content producer.
The service is provided as a prepaid subscription for a fixed term that you select at the point of purchase. It is not a licensed broadcasting distribution undertaking within the meaning of the Broadcasting Act, and it does not carry the obligations or the complaint mechanisms that apply to licensed distributors. In particular, disputes with us are not eligible for the Commission for Complaints for Telecom-television Services process.
3. Your responsibilities
By using the service, you agree to the following.
- You are solely responsible for ensuring that your use of the service complies with the laws of your province or territory and of Canada, including the Copyright Act. If you are outside Canada, you are responsible for compliance with the laws applicable where you are.
- You will keep your credentials confidential and will not share, publish, sell or resell them. Credentials found circulating publicly will be revoked without refund.
- You will not exceed the number of simultaneous connections included in your plan by technical circumvention.
- You will not use the service for any commercial purpose, including public display in a licensed premises, without a separate written agreement with us.
- You will not attempt to reverse engineer, scrape, rebroadcast or redistribute any part of the service.
- You will provide a valid email address and will keep it current, since it is our only means of contacting you.
Our Acceptable Use Policy sets out prohibited conduct in more detail and forms part of these terms.
4. Our responsibilities
We commit to the following.
- Delivering account credentials promptly after payment clears, normally within ten minutes and in any event within twenty-four hours.
- Maintaining a service availability target of 99.9%, measured monthly across our server estate.
- Providing customer support during our published hours of 8:00 AM to 12:00 AM ET, 7 days a week.
- Giving reasonable advance notice by email of planned maintenance likely to affect service.
- Honouring the 7-day money-back guarantee set out in our Refund Policy.
- Not selling, renting or otherwise disclosing your personal information to third parties, as set out in our Privacy Policy.
We do not guarantee that every channel will be available at all times. Channels are sourced from third parties and may become unavailable without notice. We will make reasonable efforts to restore or re-source an affected channel, and we will tell you honestly when a fault is at source rather than attributing it to your equipment.
5. Subscriptions, billing and renewal
Subscriptions are sold as prepaid fixed terms of one, three, six or twelve months, with one, two or three simultaneous connections. All prices are quoted and charged in Canadian dollars.
Nothing renews automatically. When your term ends, the service stops and no further charge is made. If you wish to continue, you purchase a new term.
You may upgrade the number of connections at any time during a term. The additional charge is prorated against the days remaining. We do not offer prorated downgrades within a term.
We may change our prices at any time. Price changes do not affect a term you have already purchased.
Payments are card payments only, processed by Stripe Payments Canada. Card details are entered on Stripe's hosted payment page and are never transmitted to or stored on our systems. We do not accept Interac e-Transfer, bank transfers, PayPal or cryptocurrency.
6. Free trials
We offer a free trial of 24 hours with one simultaneous connection and the complete channel and on-demand library. No payment details are required and the trial does not convert into a paid subscription.
Trials are limited to one per household. We may decline a trial request, or terminate an active trial, where we reasonably believe the limit is being circumvented.
7. Suspension and termination
We may suspend or terminate your account without refund if you breach these terms or the Acceptable Use Policy in a material way, including by sharing or reselling credentials, circumventing connection limits, or using the service commercially without agreement.
Where a breach appears inadvertent, we will normally contact you first and give you an opportunity to correct it.
You may stop using the service at any time. Because subscriptions are prepaid and do not auto-renew, no cancellation step is required; simply do not purchase a further term. Refunds within the guarantee window are dealt with in the Refund Policy.
We may discontinue the service entirely on thirty days' notice. If we do, we will refund the unused portion of any prepaid term on a prorated basis.
8. Disclaimers and limitation of liability
The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we exclude all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.
We are not liable for interruptions caused by matters outside our reasonable control, including failures of your internet connection, your equipment, your internet service provider, or third-party content sources.
Our total aggregate liability to you, on any basis, is limited to the amount you have paid us in the twelve months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable Canadian law, including provincial consumer protection legislation. If you are a consumer, you may have rights under that legislation that these terms do not affect.
9. Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the service, or your violation of any law or the rights of any third party.
10. Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in that province, without regard to conflict of law principles.
The courts of Ontario have exclusive jurisdiction over any dispute arising from these terms, except that either party may seek injunctive relief in any competent court.
Before commencing proceedings, we ask that you contact us at support@iptvhub.ca so that we have an opportunity to resolve the matter directly. In our experience most disputes are resolved that way in a day or two.
11. Changes to these terms
We may amend these terms. Where a change is material, we will notify active subscribers by email at least fourteen days before it takes effect and update the effective date at the top of this page.
Changes do not apply retroactively to a term you have already purchased. If you do not accept a material change, you may stop using the service and request a prorated refund of the unused portion of your current term.
12. General
If any provision of these terms is found unenforceable, the remaining provisions continue in effect and the unenforceable provision is modified to the minimum extent necessary to make it enforceable.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
These terms, together with the Privacy Policy, Refund Policy, Acceptable Use Policy and Copyright Policy, constitute the entire agreement between us regarding the service.
You may not assign this agreement. We may assign it in connection with a merger, acquisition or sale of assets, on notice to you.
